The UK government is preparing to legalize privately owned e-scooters on public roads, acknowledging that the current regulations are widely ignored. Transport Secretary Heidi Alexander MP stated that “the genie’s out of the bottle,” meaning many riders already use private e-scooters illegally despite laws restricting their use to private land.

Why Now? The Shift in Policy

For years, privately purchased e-scooters have been in a legal gray area, while rental schemes operating under trial programs since 2020 have been permitted on roads and cycle lanes. These rental schemes require riders to have a valid driving license and include third-party insurance. However, the widespread disregard for the private ownership rules – with many buying scooters from retailers like Halfords and using them illegally – has forced the government’s hand.

The impending legislation will aim to bring order to the situation by introducing speed limits, mandatory lights and brakes, and designated usage areas. Alexander made clear that pavements will remain off-limits for e-scooters.

Dr. Charlotte Durand of Liverpool’s Alder Hey Children’s Hospital reported an alarming increase in emergency department visits and tragic deaths since 2019. The problem is compounded by widespread public ignorance of the existing laws and the dangers involved. Most families are unaware of the risks or even that private e-scooter use is currently illegal.
